Paletra Terms of Use

These Terms of Use ("Terms") apply to the use of the Paletra mobile app and related internet services (the "Service") provided by Luka Rolik Gıda Sanayi Ticaret Limited Şirketi (Siteler Mah. 9 Eylül Cad. No: 11, İç Kapı No: 5, Aliağa / İzmir, Türkiye; info@paletra.net) ("Paletra" or "we").

By using the Service you accept these Terms. If you do not accept them, you must not use the Service.

Paletra helps you discover dishes and restaurants by your taste, see restaurants' menus, send reservation and pre-order requests, and keep your own food-related records.

Paletra:

  • is not a restaurant; it does not prepare, serve or deliver food;
  • is not a payment institution; no payment is taken through the app;
  • is not a medical, dietitian or nutrition advice service;
  • does not certify allergen safety; it does not undertake that any dish is safe for you.

3.1. You can use part of the Service as a guest, without creating an account. A guest session is tied to the session on your device; if you delete the app or sign out you may not be able to reach your guest records again. To keep your records you can create an account.

3.2. An account can be created with email and password, or with your Google or Apple account. You are responsible for the information you give being accurate and current, and for the security of your account and device. Actions taken with your account are deemed yours.

3.3. Each person should use one account, in their own name. You may not open an account in someone else's name or by impersonating someone.

4.1. Paletra's recommendations are an automatic ranking based on the preferences you state, your own marks in the app and the dish information restaurants declare. Recommendations are not advice, a guarantee or an undertaking of suitability; they do not mean you will like a dish.

4.2. Phrases such as "Excellent match", "Strong match" and "Worth trying" indicate closeness according to the information Paletra has; they are not a health or safety assessment.

4.3. Content based on zodiac sign and character traits is for entertainment and discovery; it carries no scientific or health-related claim.

5.1. Restaurant and menu information in Paletra (dish names, descriptions, ingredients, photographs, prices, opening hours) is provided by the restaurant concerned, which is responsible for its accuracy. Paletra does not independently verify it.

5.2. Prices and availability may be changed by the restaurant at any time. The price shown in the app may differ from the price charged at the restaurant; the restaurant's own current price is the one that applies.

5.3. Restaurant and menu information added by the community is user contribution, not an official restaurant declaration, and is marked as such in the app.

5.4. Menus read from QR codes and sources outside Paletra. Information read from a menu link that does not belong to Paletra belongs to the business concerned; it may be incomplete, wrong or out of date. It is not an official declaration by Paletra or by the restaurant, and must not be relied on, in particular for allergens and prices.

6.1. Paletra shows a dish's allergen information only if the restaurant has declared it. Dishes declared to contain an allergen you listed are not recommended to you.

6.2. If a dish has no allergen information, that does not mean the dish is free of allergens. Unknown information stays unknown; Paletra does not guess.

6.3. Paletra cannot know or supervise cross-contamination, kitchen practice, recipe changes or the accuracy of a restaurant's declaration.

6.4. If you have an allergy, an intolerance or a medical diet, always confirm ingredient and allergen information directly with the restaurant before you order. Nothing in Paletra replaces that confirmation.

7.1. Calorie and nutrition values shown in the app are the restaurant's declaration; they may be approximate and are not verified by Paletra. Values that are not declared are shown as "unknown"; they are not estimated.

7.2. The water, meal, step, active-energy and goal information in "My Paletra" is only for you to see your own records. Daily totals cover only the meals you logged in Paletra whose calories are known; they may not reflect your actual intake.

7.3. Nothing in Paletra is medical advice, diagnosis, treatment or a diet recommendation. For decisions about your health, consult your doctor or dietitian.

8.1. A reservation you make through Paletra is a request; it becomes final when the restaurant confirms it. The restaurant may decline or cancel the request.

8.2. The service relationship for a reservation and a pre-order is between you and the restaurant. The table being ready, and the quality, service, price and invoicing of the food, are the restaurant's responsibility.

8.3. You can cancel your reservation up to the time shown in the app. If you are not coming, please cancel; repeated no-shows may lead to your account's reservation feature being restricted.

8.4. A pre-order is not a payment; payment is made at the restaurant. Once the restaurant has started preparing, a pre-order may no longer be changeable.

8.5. The name, phone number, note and special requests you give for a reservation are passed to the restaurant.

9.1. Contribution points are given for your contributions to Paletra. They have no cash value, and cannot be converted to money, transferred or sold.

9.2. Rewards are subject to the terms of the restaurant and the reward concerned; they may be limited by stock and time. Paletra may change or end the rewards programme.

9.3. Points and rewards gained by fraud or in breach of the rules may be cancelled. When you delete your account, your points and unused rewards end.

10.1. Reviews, comments, guides, photographs, polls, meetups and the restaurant or menu information you add to the community ("Content") belong to you, and you are responsible for them.

10.2. You accept that your Content is based on your own real experience, is accurate, that you have the right to publish it, and that it does not infringe third parties' rights.

10.3. Licence. By publishing your Content in Paletra you give Paletra a non-exclusive, royalty-free permission to use, host, reproduce, adapt (changes of format and size), publish and display that Content within the Service, for the purpose of providing, operating and promoting the Service.

10.4. Images you upload. You may upload only images you took yourself or have the right to use. If other people appear in an image, obtaining their consent is your responsibility.

10.5. Collaboration disclosure. If, as a Paletra Guide, you publish content in return for payment, a free meal or any other benefit from a restaurant, you must state this clearly using the collaboration disclosure in the app.

10.6. Paletra may remove, or restrict the visibility of, Content it considers contrary to these Terms, the community rules or the law. Paletra is not obliged to review Content before it is published.

10.7. When you see inappropriate content you can use the "Report" option in the app or info@paletra.net.

When using the Service you may not:

  • write a review that is fake, misleading or about a restaurant you did not visit; publish content for or against a restaurant in return for a benefit without disclosing it;
  • tap "I'm here" when you are not actually there, spoof your location or mislead visit verification;
  • share insults, threats, harassment, hate speech, obscene or unlawful content; share other people's personal data without permission;
  • make reservations you do not intend to keep;
  • carry out fake actions, or use more than one account, to gain points or rewards;
  • access the Service with automated tools, scrape data, try to circumvent security measures, or disrupt the Service's operation;
  • reverse-engineer the app or try to obtain its source code (save where the law permits);
  • use the Service for an unlawful purpose.

The Paletra name, logo, design, software and content created by Paletra belong to Paletra or its licensors. As long as you comply with these Terms you are given a limited, non-transferable, non-exclusive and revocable right to use the Service for personal, non-commercial purposes. Names, logos and images belonging to restaurants belong to those restaurants.

The Service may contain referrals to restaurants' services, to map apps and to third parties' websites. These are not under Paletra's control; the third party concerned is responsible for their content and practices.

We work to provide the Service without interruption or error, but we cannot undertake that. The Service may be temporarily unavailable because of maintenance, updates, technical faults or causes beyond our control. We may change, add or remove features.

15.1. You can delete your account at any time inside the app (see the Account Deletion page).

15.2. We may suspend or terminate your account, or your access to particular features, if you breach these Terms, misuse the Service, or where the law requires.

16.1. The Service is provided "as is". To the extent the law permits, Paletra cannot be held liable for the accuracy of information provided by restaurants (menu, ingredients, allergens, calories, price, opening hours), for the food and services restaurants provide, for user content, or for menu information read from third-party sources.

16.2. Paletra does not undertake that recommendations will produce any particular result.

16.3. Nothing in this section removes your rights arising from intent, gross fault or other liability that cannot lawfully be limited, or your rights as a consumer under mandatory provisions.

How your personal data is processed is explained in the Privacy Policy and the KVKK Information Notice. Those documents are not annexes to the Terms; they are for information.

We may update these Terms. The current text is published in the app and at https://paletra.net/terms. We will notify you of material changes before they take effect and, where required, ask for your renewed acceptance.

These Terms are governed by the law of the Republic of Türkiye. The right of users acting as consumers to apply, under Law No. 6502, to the consumer arbitration committees and consumer courts of their place of residence is reserved. For disputes that are not consumer transactions, the courts and enforcement offices of İzmir have jurisdiction.
